These Terms of Service ("Terms") govern your use of Yaps products, including Yaps voice tools and the Snap.Yaps screen recorder and editor (together, "the Service"), operated by Yaps ("we", "us", "our"). By using the Service, you agree to these Terms.
Acceptance of Terms
By downloading, installing, or using Yaps, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Description of Service
Yaps provides speech-to-text dictation, text-to-speech, voice notes, a studio editor, voice commands, mobile keyboard features, and a local vault that stores notes as Markdown files. The Service also includes Agent Access, which lets you connect compatible external AI clients to request information from, and if you explicitly allow it, write to your vault. Snap.Yaps provides local screen, window, audio, and optional webcam capture; a timeline editor; on-device captions; visual effects; and MP4 and GIF export. The Service may include both free and paid features.
Recording, Notice, and Consent
You choose what Snap.Yaps records and are responsible for using it lawfully. Before recording a person, conversation, meeting, workplace, confidential system, or third-party content, obtain any notice, permission, or consent required by applicable privacy, recording, employment, confidentiality, and intellectual-property laws. Recording rules vary by location and context; Snap.Yaps does not determine whether a particular recording is lawful.
Do not use the Service to record, publish, or distribute content when you do not have the legal right to do so. You are responsible for your recordings and exports and for how you share or publish them.
External AI Clients
You choose whether to connect a third-party AI client through Agent Access. Connected clients are provided by third parties and operate under their own terms, privacy policies, account settings, and data retention practices. Review those terms before asking a client to retrieve vault content. New connections are read-only; you control whether to enable writes for each client and may revoke or disconnect access at any time.
License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to use Yaps on devices you own or control, subject to these Terms. You may not copy, modify, distribute, sell, or lease any part of the software, nor may you reverse-engineer or attempt to extract source code.
Account Registration
Some features require an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to provide accurate information and to update it as needed.
You must be at least 13 years old to create an account. If you are under the age at which you can consent to personal data processing for online services in your jurisdiction, you may use Yaps only with permission from a parent or guardian.
Subscription and Billing
Paid features are available through monthly or annual subscription plans. The price, billing interval, taxes, and renewal terms are shown before purchase. Subscriptions renew automatically unless you cancel before the renewal date. For a direct Snap.Yaps purchase, you can cancel through the Stripe billing portal opened from the app; cancellation stops future renewals and paid access normally continues through the current paid period.
Prices may change with at least 30 days' notice and any change applies to a future renewal, not a period already paid for. Refunds and cancellation or cooling-off rights are handled according to the terms shown at purchase and applicable law. App Store purchases remain subject to Apple's billing and refund process. Nothing in these Terms limits a mandatory consumer right that cannot lawfully be limited.
Acceptable Use
You agree not to:
- Use Yaps for any unlawful purpose.
- Attempt to gain unauthorized access to any part of the Service.
- Interfere with or disrupt the Service or its servers.
- Use the Service to transmit harmful content, including malware or spam.
- Resell, sublicense, or commercially exploit the Service without authorization.
Voice Generation
Yaps includes on-device voice generation built on third-party AI models licensed to us under the BigScience Open RAIL-M License. By using the voice features, you agree not to use them, or anything they produce, to:
- in any way that violates an applicable national, federal, state, local, or international law or regulation;
- to exploit, harm, or attempt to exploit or harm minors in any way;
- to generate or share verifiably false information or content with the purpose of harming others;
- to generate or share personally identifiable information that can be used to harm an individual;
- to place generated audio in any context where it could be taken for a recording of a real person, without expressly and intelligibly disclosing that it was machine generated;
- to defame, disparage, or otherwise harass others;
- to impersonate or attempt to impersonate others without their consent, including by producing synthetic speech in their voice;
- for fully automated decision-making that adversely affects a person's legal rights, or that creates or modifies a binding, enforceable obligation;
- for any use intended to, or having the effect of, discriminating against or harming individuals or groups based on their online or offline social behavior, or on known or predicted personal or personality characteristics;
- to exploit the vulnerabilities of a specific group of people based on their age or their social, physical, or mental characteristics, in order to materially distort the behavior of a person in that group in a way that causes, or is likely to cause, physical or psychological harm;
- for any use intended to, or having the effect of, discriminating against individuals or groups on the basis of legally protected characteristics or categories;
- to provide medical advice or to interpret medical results;
- to generate or share information for use in the administration of justice, law enforcement, immigration, or asylum processes, such as predicting that an individual will commit fraud or a crime.
These restrictions come from the license of the underlying models and apply in addition to the rest of these Terms. You are accountable for the audio you generate and for how it is used afterwards, and you must pass these restrictions on to anyone you share it with.
Third-Party Model Licenses
The voice generation described above is built on the following third-party model:
- Supertonic 3: voice generation. Model weights © Supertone Inc., licensed under the BigScience Open RAIL-M License. Supporting code licensed under the MIT License.
A full copy of the BigScience Open RAIL-M License is available at /licenses/bigscience-openrail-m.txt. The Yaps desktop, iOS, and Android apps download these model weights to your device; by downloading them you receive them subject to that license, including the use restrictions above.
Yaps also uses other on-device models for speech recognition, translation, and other offline features, each under its own license. Those models and their licenses are listed under Acknowledgements on the About screen inside the app.
Intellectual Property
Yaps and all related trademarks, logos, and content are the property of Yaps or its licensors. Your content remains yours—we claim no ownership over text, voice recordings, screen recordings, projects, captions, or exports you create with Yaps. Snap.Yaps keeps this content on your device unless you choose to send something to us, such as a support attachment.
Disclaimers
Yaps is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that speech recognition will be perfectly accurate, that the Service will be uninterrupted, or that it will meet your specific requirements.
Limitation of Liability
To the fullest extent permitted by law, Yaps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, or affects rights and remedies that applicable consumer law gives you.
Termination
We may suspend or terminate your access to Yaps at any time for violation of these Terms, with or without notice. You may stop using the Service at any time. Upon termination, your license to use Yaps ends immediately.
Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law provisions.
Changes to These Terms
We may revise these Terms from time to time. Material changes will be communicated via email or an in-app notice at least 30 days before they take effect. Continued use after changes constitutes acceptance.
